Puna Pay

Terms of Service

Effective September 23, 2026

These terms cover your use of punapay.com and the enquiries you send us through it.

The short version: this site is informational, nothing on it is a quote or an offer, we are a sales partner rather than the processor, and opening a merchant account depends on underwriting approval we do not control.

1. Acceptance of these terms

These terms are an agreement between you and Bittsi, Inc., trading as Puna Pay (“Puna Pay”, “we”, “us”). By using punapay.com or sending us an enquiry, you accept them. If you do not accept them, do not use the site. If we change them, continued use after the change means you accept the updated version.

2. What this site is — and what it is not

This site describes merchant payment-processing services and lets you ask us to look at what you pay today. It is informational.

Nothing on this site is an offer, a quote, or a binding commitment. Pricing depends on your card mix, your volume, and the terms of the agreement you eventually sign. Any figure shown on this site — including anything produced by the estimator on the pricing page — is an illustration based on the numbers you entered, not a quote.

We are not the processor. Puna Pay is an independent Sales Partner. Card processing, underwriting, settlement and the merchant agreement itself are provided by the processing platform we resell, under its own contract with you.

3. Eligibility

This site is for businesses. You must be at least eighteen and authorised to act for the business you are enquiring about. The services described are offered to businesses operating in the United States.

4. Enquiries you send us

When you submit a form, you confirm that the information is accurate and that you are entitled to share it. You authorise us to use it to prepare a comparison and a proposal, and to share it with our processing partner for that purpose, as described in our Privacy Policy.

We aim to respond within one business day. That is a service commitment, not a guarantee, and nothing in it obliges us to make an offer.

Do not send processing statements, card numbers, bank credentials or personal identification documents through this site or by email. We do not accept them.

5. No guarantee of approval, pricing or savings

Opening a merchant account requires underwriting approval by the processor. We do not make that decision and cannot promise an approval, a timeline, or particular terms.

Any comparison we prepare is based on the information available to us at the time. Your actual costs depend on your card mix, transaction sizes, chargebacks, and how your business changes — all of which move. We do not guarantee any level of saving.

6. Acceptable use

You agree not to:

  • use the site unlawfully or for any purpose other than evaluating our services;
  • attempt to gain unauthorised access to the site or any related system;
  • interfere with the site’s operation, or scrape or harvest its content;
  • reverse-engineer any part of the site;
  • misrepresent who you are or who you act for; or
  • submit false information, malware, or abusive content.

We may restrict access if you do any of these.

7. Intellectual property

The content, design and branding of this site belong to Bittsi, Inc. or its licensors. You may view and print pages for the purpose of evaluating our services. You may not copy, republish, or make commercial use of the content without our written permission. Product names and logos belonging to other companies remain their property, and appear here only to identify the equipment and platforms we work with.

8. Third-party services and links

This site references and links to other organisations, including the processing platform we resell and the manufacturers of the equipment we sell. Those organisations operate independently and under their own terms. We are not responsible for their services, their content, or their decisions.

9. Privacy

Our Privacy Policy explains what we collect through this site, how we use it, and who we share it with. It forms part of these terms.

10. Disclaimer of warranties

The site is provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the site will be uninterrupted or error-free, that the information on it is complete or current, or that any estimate, comparison or general guidance on it will match your circumstances. Nothing on this site is legal, tax or accounting advice.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost data or business interruption, arising from your use of this site.

Our total liability arising out of or relating to this site is limited to one hundred US dollars ($100) or the amount you have paid us in the twelve months before the claim, whichever is greater.

This section does not limit liability that cannot be limited by law, and it does not affect the terms of any separate merchant agreement you sign, which has its own provisions.

12. Indemnification

You agree to indemnify and hold harmless Bittsi, Inc., its officers and employees from claims, losses and reasonable legal costs arising from your use of the site, your breach of these terms, or information you submit that is inaccurate or that you were not entitled to share. This survives termination.

13. Dispute resolution and governing law

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules.

Before starting formal proceedings, you agree to contact us and give us thirty days to resolve the matter informally. If that fails, disputes will be resolved by binding arbitration administered by JAMS or the American Arbitration Association, in Delaware or in the federal judicial district where you are located.

Each party may bring claims only on an individual basis, and not as a plaintiff or class member in any class or representative proceeding. Both parties waive the right to a jury trial. You may opt out of this arbitration agreement by writing to us within thirty days of first accepting these terms.

14. Changes and termination

We may change these terms or the site at any time, and we may restrict or discontinue access without notice. Changes take effect when posted, and the effective date at the top of this page will be updated. The sections on intellectual property, disclaimers, limitation of liability, indemnification and dispute resolution survive.
